Terms of Service

These Terms of Service ("Terms") govern your use of GANTT360° ("the Service"), a web-based GANTT chart application operated by BOTFORCE GmbH, Wienerbergstraße 11/12A, A-1100 Wien, Austria ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

GANTT360° is a SaaS platform for creating, editing, and sharing presentation-grade GANTT charts. Features include drag-and-drop editing, version history, .pptx/.pdf/.png export, shareable links, AI-powered project analysis, and theme customization. The Service is provided "as is" via web browser.

3.1 You must provide a valid email address to create an account.
3.2 You are responsible for maintaining the confidentiality of your credentials.
3.3 You must be at least 16 years old to use the Service.
3.4 One person or legal entity may not maintain more than one free account.

4.1 The Service offers Free, Pro, and Team plans as described on our pricing page.
4.2 Prices are in EUR and exclude applicable VAT.
4.3 Paid subscriptions are billed monthly or annually via Stripe.
4.4 We reserve the right to change prices with 30 days' notice. Existing subscriptions remain at their current price until renewal.
4.5 Free plan limitations (charts, projects, versions, features) are enforced at our discretion.

5.1 Paid subscriptions renew automatically unless canceled before the renewal date.
5.2 You may cancel at any time. Access continues until the end of the current billing period.
5.3 No refunds are provided for partial billing periods.
5.4 If payment fails, we may suspend access after 7 days and terminate after 30 days.

6.1 You retain full ownership of all content you create in GANTT360° (charts, tasks, milestones, themes, etc.).
6.2 You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.
6.3 You may export your data at any time in .pptx, .pdf, or .png format.
6.4 Upon account deletion, we will delete your data within 30 days, except where retention is required by law (§ 7 Austrian BAO).

7.1 GANTT360° includes AI-powered features: AI Chart Editing, AI Project Analysis, What-If Scenario Analysis, SteerCo Script Generator, and PM Advisor. These features use Anthropic's Claude API to process your data.
7.2 When you use AI features, the following data may be sent to Anthropic: chart structure (tasks, dates, milestones, dependencies, progress, owner names), your text prompts, and any files you upload (images, PDFs, documents).
7.3 Anthropic does not use API inputs for model training. Data is processed in transit and not retained by Anthropic after the request completes.
7.4 All AI outputs — including project analysis, scenario simulations, speaking scripts, and PM advice — are decision-support tools only. They do not constitute professional project management, legal, or financial advice.
7.5 You are solely responsible for verifying AI outputs before acting on them, sharing them with stakeholders, or using them in presentations.
7.6 We are not liable for decisions made based on AI-generated content, including incorrect date calculations, risk assessments, or stakeholder communications.
7.7 AI features are opt-in and triggered only by explicit user action (clicking a button, sending a prompt, or uploading a file).
7.8 The PM Advisor automatically extracts structured facts ("Project Notes") from conversations — including deadlines, decisions, risks, and action items. These notes are stored in our database and persist across sessions. Raw emails, file contents, and full conversation logs are not stored.
7.9 You can delete Project Notes at any time by marking them as resolved.

You agree not to:
• Use the Service for any unlawful purpose
• Upload malicious code, exploit vulnerabilities, or attempt unauthorized access
• Share accounts or resell access without authorization
• Systematically scrape or extract data from the Service
• Use the Service to store sensitive personal data (health, financial, etc.) beyond what is necessary for project management labels

9.1 We target 99.5% uptime but do not guarantee uninterrupted availability.
9.2 Planned maintenance will be announced at least 24 hours in advance where possible.
9.3 We are not liable for downtime caused by third-party providers (Vercel, Supabase, Stripe).

10.1 GANTT360°, its logo, design, and underlying code are the intellectual property of BOTFORCE GmbH.
10.2 Your use of the Service does not transfer any IP rights to you beyond the right to use the Service per these Terms.
10.3 The exported .pptx/.pdf/.png files you generate are yours.

11.1 Our liability is limited to direct damages caused by gross negligence or willful misconduct, up to the amount paid by you in the 12 months prior to the claim.
11.2 We are not liable for indirect, incidental, consequential, or special damages, including loss of data, revenue, or business opportunities.
11.3 The Service is not designed for safety-critical or regulated industries. You are solely responsible for compliance with your industry's regulations.

12.1 You may terminate your account at any time by contacting office@botforce.at.
12.2 We may terminate or suspend your account if you violate these Terms, with reasonable notice where possible.
12.3 Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days to allow export, then delete it.

We may modify these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

14.1 These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
14.2 The exclusive place of jurisdiction is Vienna, Austria.
14.3 If you are a consumer within the EU, mandatory consumer protection laws of your country of residence apply where they offer greater protection.
